But I don't agree if it's banning the creation of violent games (and rapeplay).

That's what rating are, so it's strange for a minor to buy AO or 18+ games in the first place anyway. Personally, I agree with banning minor to buy violent games. If not parents, minor could easily ask other grown up to buy them those games (which is exactly the case). Some of those parents even realize what kind of game they bought for their own children. I read somewhere that at more case, it's the parents themselves that bought their own children (who's still minor) those violent games. Scalia may be more correct in saying that Alito's arguments only make video games more protected by the first amendment. Other games he mentioned have been made by amateurs and are not sold in stores, also making them irrelevant to this case. (Most of the technology he mentions has not been invented or implemented in a way he describes.) In addition, many of the games he mentioned (including RapeLay) are already rated adults only and cannot be legally purchased by minors, so I don't know what his point is. If simple shock and moral outrage is enough to impose a ban of certain material, then could a neo-Nazi gang member be arrested for hacking apart an effigy of President Obama with an ax in a political protest? His argument is also based on hypothetical worst case scenarios that have yet to come to pass. There was no real way that the law would have been upheld given the strength of the first amendment and the facts of the case.Īn interesting question raised by Scalia's final argument on page 16 isĭoes banning the sale of violent video games to minors violate the parent's right to not care what their kids buy? Or reworded, does the First Amendment give parents the right to not care about what their kids buy?Īlito's argument seems to be pretty weak. I thought it was an unsurprising outcome.
